Withdrawal information
Withdrawal instructions
Consumers have a right of withdrawal as set out below. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession.
Right of withdrawal
You have the right to withdraw from this contract within fourteen days without giving any reason.
The withdrawal period will expire after fourteen days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the last good.
To exercise the right of withdrawal, you must inform us (Tukwila Supermarket, owner Dr. Shahinur Rahman, Bautzner Straße 16, 01099 Dresden, Germany, phone: +49 351 65399981, e-mail: [email protected]) of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post or an e-mail). You may use the attached model withdrawal form, but it is not obligatory.
You can also declare your withdrawal electronically using the withdrawal function on our website, which you reach via the button “Withdraw from contract here” (on the German site: „Vertrag hier widerrufen“) at https://tukwila.de/widerruf/; there you submit your statement with the button “Confirm withdrawal” („Widerruf bestätigen“). If you use this option, we will send you, without undue delay, an acknowledgement of receipt of your withdrawal by e-mail, stating its content and the date and time of receipt.
To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.
Effects of withdrawal
If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than fourteen days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.
You shall send back the goods or hand them over to us (Tukwila Supermarket, Bautzner Straße 16, 01099 Dresden, Germany) without undue delay and in any event not later than fourteen days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of fourteen days has expired.
You will have to bear the direct cost of returning the goods.
You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.
Exclusion or early expiry of the right of withdrawal
There is no right of withdrawal for contracts
- for the supply of goods that are liable to deteriorate rapidly or whose expiry date would be exceeded rapidly (Section 312g(2) no. 2 German Civil Code, BGB). In our range this includes in particular fresh fruit and vegetables, fresh herbs, fresh and frozen meat (including fresh halal meat ordered via WhatsApp), fresh and frozen fish, all other chilled and frozen goods that we deliver by chilled shipping (e.g. paneer, yoghurt, frozen paratha, samosas, kebab), and fresh sweets and baked goods (e.g. fresh laddu, peda, milk cake, baklava);
- for the supply of goods that are not prefabricated and for whose production an individual selection or determination by the consumer is decisive, or that are clearly tailored to the consumer’s personal needs (Section 312g(2) no. 1 BGB), in particular fresh halal meat that we cut and portion for you after your order.
The right of withdrawal expires early for contracts for the supply of sealed goods that are not suitable for return for health protection or hygiene reasons if their seal has been removed after delivery (Section 312g(2) no. 3 BGB). This applies, for example, to opened food packaging and to cosmetics and personal care products whose closure or protective seal has been removed.
Frozen goods count as goods that are liable to deteriorate rapidly, because after delivery it can no longer be established whether the cold chain was maintained. Sweets in tins, jars or other packaging that keeps without refrigeration (e.g. tinned rasgulla or gulab jamun), on the other hand, are not liable to deteriorate rapidly.
The right of withdrawal does apply to unopened, shelf-stable food (e.g. rice, lentils, flour, spices, tea, tinned food, snacks and sweets in shelf-stable packaging), to clothing and to household goods. If your order contains both goods that can be withdrawn and goods for which the right of withdrawal is excluded, you can withdraw from the contract in respect of the goods that can be withdrawn.

How the online withdrawal works
The quickest way to withdraw is our withdrawal function. It consists of two buttons, labelled “Withdraw from contract here” and “Confirm withdrawal” on the English site and „Vertrag hier widerrufen“ and „Widerruf bestätigen“ on the German site. The button “Withdraw from contract here” is in the footer of every page of our shop; it leads to tukwila.de/widerruf/ and is available throughout the withdrawal period, including if you ordered without a customer account.
- Enter your order number (it is in your order confirmation) and the e-mail address you used for the order.
- On the next page, check your details and the order you want to withdraw from, and click “Confirm withdrawal”. Your withdrawal is only submitted with this click. You do not have to give a reason.
- You immediately receive an e-mail confirming the content of your withdrawal and the date and time of receipt, together with the address for returning the goods. Please keep this e-mail. If it does not arrive, please check your spam folder and contact us.
You can of course still declare your withdrawal by letter or e-mail, for example using the model withdrawal form above. Information on sending goods back is on our page “Returns and complaints”.
